Conditions of SaleHawaii State Law
Hawaii state law requires that Timeshare Resales Hawaii agents be licensed with the State of Hawaii, and be under the supervision of a licensed Broker.
DROA (Deposit, Receipt, Offer, and Acceptance)
The DROA must be completed by all buyers and sellers to constitute a sale between the parties. For a DROA to be accepted it must be completed by the buyer along with a deposit in the amount of $2,500.00 payable by check or cashier's check made out to "Timeshare Resales Hawaii Client Trust Account". Credit cards (Master Card, Visa, Discover or American Express) for deposits only are also accepted.
Agency Disclosure
Timeshare Resales Hawaii and all its sales people represent the Seller in an exclusive agency agreement. Buyers are represented by the Buyer. Both Buyer and Seller will acknowledge this in the DROA.
Disclosure Statement
Hawaii State Law requires that all clients must receive the most current Disclosure Statement on the property that they are purchasing. The buyer has a seven day right of rescission period commencing on the date they receive the Disclosure Statement.
HARPTA
This is Hawaii state tax of 5% of the gain on a sale. It is very important for the seller to provide escrow with a copy of a contract or conveyance document, stating the price they paid for the unit. If the seller paid more for their unit than they sold it for, this tax can be exempted.
FIRPTA
This is a Federal tax of 10% of the amount realized. This only affects the sellers if they are not U.S. citizens. This is withheld in escrow.
Escrow Company and Closing Costs
Closing costs generally includes title insurance, service and processing fees, document preparation, recording fees, mailing and handling fees. Closing is done by a Title Company that is not affiliated with Timeshare Resales Hawaii or Bay Realty, Inc.
Cancellation of Time-share Listing or Purchase Agreement
A Seller or Buyer may cancel a contract as outlined in the contract in which they signed with Timeshare Resales Hawaii. Refunds and or Cancellation fees will apply as outlined in these documents. Timeshare Resales Hawaii will not be responsible for any fees incurred by the escrow/title company due to changes made by the Buyer or Seller.
